These Terms of Use ("Terms") are an agreement between you and Fortis Calcs LLC ("Fortis Calcs," "we," "us," or "our"). They govern your use of the MissionLine OS website at missionlineos.com, including its pages, articles, examples, calculators, downloadable templates, the beta waitlist, and the design-partner application (together, the "Site").

Please read them carefully. They include an engineering disclaimer, a disclaimer of warranties, a limitation of liability, and a choice of Colorado law and courts.

The MissionLine OS application has its own terms of service, which you will see when you create an app account. These Terms cover the Site only.

1. Accepting these Terms

By using the Site, you agree to these Terms. When you submit a form on the Site, you also confirm that you have read our Privacy Policy. If you do not agree, please do not use the Site.

If you use the Site for a company or other organization, you confirm that you may accept these Terms for it. In that case, "you" includes that organization.

2. Who the Site is for

The Site is for professionals using it for business purposes, such as engineers, developers, contractors, and owners' representatives. You must be at least 18 years old to submit a form on the Site. The Site is not directed to children.

3. Engineering disclaimer

The Site is not an engineering service. Articles, examples, calculators, templates, and other technical content on the Site are general information and preliminary design aids. They are not stamped, sealed, or certified engineering, and they are not for construction or permit. Using the Site does not create an engineer-client relationship with Fortis Calcs LLC or anyone associated with it.

Our Engineering Disclaimer is part of these Terms. Please read it before you rely on any technical content.

4. The waitlist and the design-partner program

  • Waitlist. Joining the waitlist asks us to contact you about early access to MissionLine OS. It does not guarantee access, a launch date, a price, or any particular feature. We decide who is invited and when.
  • Design partners. Applying to the design-partner program does not make you a design partner. If we accept you, the Beta Program Terms apply to your participation, together with any separate written agreement we both sign.
  • Accurate information. Please give accurate contact details and use your own email address.
  • Confidential information. Do not include client-confidential project information, drawings, or security-sensitive details about any facility in a form on the Site.

5. Templates and downloads

Templates, example one-line diagrams, and other downloads from the Site are illustrative examples for preliminary design. You may use and modify them for your own internal business and project work. You may not sell, sublicense, or redistribute them as templates, or remove the notices on them. They are subject to the Engineering Disclaimer.

6. Calculators and examples

Calculators on the Site use simplified methods and the values you enter. Example and default values are illustrative only. Results are preliminary estimates and may differ from the results of a full study in the MissionLine OS app or any other tool. See the Engineering Disclaimer.

7. Articles, project analyses, and third-party names

  • Sources and opinions. Some articles discuss publicly reported projects, permit and public-record information, industry data, and equipment lead times. Our analysis and estimates are our opinions, based on the sources we cite and on stated assumptions. They are not statements of fact about how any project was actually designed or built.
  • No affiliation. Company, product, and project names on the Site belong to their owners. We use them only to identify those companies, products, or projects. Their appearance does not mean that any of them is affiliated with, sponsors, endorses, or uses MissionLine OS, unless we say so expressly with their permission.
  • Lead times and costs. Lead-time and cost information is a dated estimate from the sources we describe. It is not a quote, a commitment, or procurement advice.
  • Corrections. If you believe something on the Site is inaccurate, or that it uses your material or name improperly, email support@missionlineos.com with the page address and the details. We review every request and correct or remove content where appropriate.

8. Our intellectual property

The Site and its content, including text, graphics, diagrams, calculators, templates, software, and design, are owned by Fortis Calcs LLC or its licensors and are protected by law. Apart from the rights in Section 5 and normal browsing, sharing links, and quoting short excerpts with attribution, you may not copy, republish, or create derivative works from the Site without our written permission.

Trademarks. MissionLine OS and MissionLine are trademarks of Fortis Calcs LLC. NFPA 70®, National Electrical Code®, and NEC® are registered trademarks of the National Fire Protection Association, Quincy, MA. Fortis Calcs LLC and MissionLine OS are not affiliated with or endorsed by the National Fire Protection Association. Other trademarks belong to their owners.

9. Feedback

If you send us suggestions, ideas, or feedback about the Site or MissionLine OS, we may use them for any purpose without paying you or owing you anything.

10. Acceptable use

You agree not to:

  • submit false information, use someone else's email address, or submit forms automatically;
  • bypass, disable, or interfere with the bot-protection check or any other security feature;
  • scrape, crawl, or bulk-copy the Site's content, calculators, or templates, except as standard search-engine indexing allows;
  • probe, scan, overload, or disrupt the Site, or upload malware;
  • use the Site to violate any law or professional rule, or to infringe anyone's rights.

11. Third-party links and services

The Site may link to third-party websites and sources. We do not control them and are not responsible for their content or practices. The Site uses service providers for hosting, cookieless website analytics, form storage, bot protection, and email, as described in our Privacy Policy.

12. Disclaimer of warranties

THE SITE AND ALL CONTENT, CALCULATORS, EXAMPLES, AND TEMPLATES ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, FORTIS CALCS LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT ANY CALCULATION, CODE REFERENCE, TYPICAL VALUE, LEAD TIME, OR COST ESTIMATE IS CORRECT, CURRENT, OR SUITABLE FOR YOUR PROJECT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THESE MAY NOT APPLY TO YOU.

13. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW:

(a) FORTIS CALCS LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, BUSINESS, GOODWILL, OR DATA, OR FOR DESIGN ERRORS, CODE VIOLATIONS, EQUIPMENT DAMAGE, POWER OUTAGES OR DOWNTIME, CONSTRUCTION DEFECTS, REWORK, PROJECT DELAYS, PROPERTY DAMAGE, OR PERSONAL INJURY ARISING FROM YOUR USE OF OR RELIANCE ON THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

(b) OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

(c) These limits apply to every theory of liability, whether contract, tort (including negligence), strict liability, or otherwise. They do not limit liability that the law does not allow to be limited, such as liability for fraud, or for gross negligence or willful misconduct where the law does not allow it to be limited.

14. Indemnity

You will defend, indemnify, and hold harmless Fortis Calcs LLC and its members, managers, employees, contractors, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of or reliance on the Site, including any design, document, or decision based on its content; (b) anyone else's reliance on work you produce using the Site; (c) your breach of these Terms; or (d) your violation of any law or third-party right.

15. Governing law and venue

These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. Any such dispute must be brought exclusively in the state courts located in Arapahoe County, Colorado, or in the United States District Court for the District of Colorado, and you and we consent to the personal jurisdiction of those courts. Either party may bring an individual claim in small claims court where it qualifies.

Before filing a claim, please email support@missionlineos.com so we can try to resolve it informally within 30 days.

16. Changes to the Site and these Terms

We may change, suspend, or discontinue any part of the Site at any time. We may also update these Terms. When we do, we will post the new version here with a new "Last updated" date. Changes apply from that date and are not retroactive. If you keep using the Site after that date, you accept the updated Terms.

17. General

  • Entire agreement. These Terms, the Privacy Policy, the Engineering Disclaimer, and, for design partners, the Beta Program Terms are the entire agreement between you and us about the Site. If marketing text on the Site conflicts with these documents, these documents control.
  • Severability. If any part of these Terms is found unenforceable, the rest remains in effect, and that part will be enforced to the maximum extent allowed.
  • No waiver. Our failure to enforce a provision is not a waiver of it.
  • Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets, or to an affiliate.
  • Electronic communications. You agree that we may communicate with you electronically, and that electronic notices satisfy any requirement to be in writing.
  • Independent parties. Nothing in these Terms creates a partnership, employment, agency, or engineer-client relationship.
