Beta Program Terms

MissionLine OS™ early access and design-partner program, operated by Fortis Calcs LLC Effective date: October 27, 2026 Last updated: October 27, 2026

These Beta Program Terms ("Beta Terms") apply when Fortis Calcs LLC ("Fortis Calcs," "we," "us," or "our") invites you to early access to MissionLine OS, or accepts you into its design-partner program (together, the "Beta Program"). They add to our Terms of Use, Privacy Policy, and Engineering Disclaimer, which also apply.

The MissionLine OS application has its own terms of service and privacy notice, which you will accept when you create an app account. If those app terms conflict with these Beta Terms about your use of the app, the app terms control. If you and we sign a separate written design-partner agreement, that agreement controls where it conflicts with these Beta Terms.

1. Accepting these Beta Terms

You accept these Beta Terms by checking the agreement box on the design-partner application, by accepting an early-access invitation, or by using any beta feature. If you participate for a company, you confirm that you may accept these Beta Terms for it, and "you" includes that company.

2. What the Beta Program is

The Beta Program gives selected professionals early access to pre-release versions of MissionLine OS ("Beta Features") so they can try them and tell us what works and what doesn't. Participation is by invitation. We may accept or decline any application, and we may limit the number of participants.

3. Pre-release software, provided as is

  • Features can change. Beta Features are unfinished. They may contain errors, give incorrect results, change, or be removed at any time, with or without notice.
  • No service level. There is no uptime commitment, no support-response commitment, and no service-level agreement. We will try to respond to questions and reports, but we don't promise to.
  • Your data. Keep your own copies of anything you need. Beta data may be lost, or we may need to reset it. If we plan a reset, we will try to give you notice so you can export your work first.
  • As is. BETA FEATURES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND. The disclaimer of warranties and the limitation of liability in our Terms of Use apply to the Beta Program.

4. Engineering disclaimer

Our Engineering Disclaimer is part of these Beta Terms. In particular:

  • Beta Features are preliminary design aids. Their outputs are not stamped, sealed, or certified engineering, and they are not for construction or permit.
  • Do not rely on beta outputs for documents you issue, submit for permit, or use for construction or procurement unless an appropriately licensed engineer of record has independently verified them and takes responsibility for them.
  • Participation does not create an engineer-client relationship with Fortis Calcs LLC or anyone associated with it.

5. Your responsibilities

  • Permission to use project information. Use only information you have the right to use. Before you enter real project information, make sure you have permission from your client and your employer to store it with a commercial cloud software provider.
  • Restricted information. Do not enter classified information, Controlled Unclassified Information, export-controlled technical data, Critical Energy/Electric Infrastructure Information, or other information whose storage with a commercial cloud provider is restricted. Avoid security-sensitive details about specific facilities, such as protection settings or physical security arrangements.
  • Your own login. Keep your login private, and do not share your access with anyone outside your organization unless we agree in writing.
  • Acceptable use. Do not reverse engineer Beta Features, use them to build a competing product, or probe or disrupt their security.

6. Feedback

We welcome your bug reports, suggestions, and other feedback ("Feedback"). You grant Fortis Calcs LLC a perpetual, irrevocable, worldwide, royalty-free license to use, copy, modify, and incorporate Feedback into its products and services for any purpose, without any obligation to you. Feedback does not include your project data, and we will not publish Feedback in a way that identifies you or your company without your permission.

7. Testimonials and use of your name

We will not use your name, your company's name or logo, or a quote from you in our marketing unless you give us separate written permission (email is fine). If we publish a quote or case study from a participant who received free or discounted access or another benefit, we will disclose that connection.

8. Confidentiality of non-public features

  • What is confidential. Beta Features, unreleased features, roadmaps, pricing plans, and other non-public information we share with you in the Beta Program are our confidential information.
  • What you agree to. You will use our confidential information only to take part in the Beta Program, and you will not disclose it to anyone except your own colleagues who need to know it and who are bound to keep it confidential. Do not publish screenshots, recordings, benchmarks, or reviews of Beta Features without our written permission.
  • Exclusions. This section does not apply to information that is or becomes public through no fault of yours, that you already knew without a duty of confidentiality, that you receive from someone else without a duty of confidentiality, or that you develop independently. You may disclose information when the law requires it, after giving us notice where the law allows.
  • How long. These obligations last during your participation and for two years after it ends.
  • Your information. We handle the information you give us as described in our Privacy Policy and the app's privacy notice. We do not publish your project data or use it to create public templates or content without your written permission.

9. Fees

Participation in the Beta Program is free unless you and we agree otherwise in writing. Any discount, founding-partner price, or other commercial offer applies only if it is set out in a written agreement or an order you accept. Beta access does not guarantee that MissionLine OS will be offered at any particular price, or for free, after the Beta Program ends.

10. Changes, suspension, and ending the Beta Program

  • Changes. We may change the Beta Program, Beta Features, or these Beta Terms. If we change these Beta Terms, we will post the new version here with a new "Last updated" date and tell current participants by email before material changes take effect.
  • Ending participation. You may leave the Beta Program at any time by emailing support@missionlineos.com. We may suspend or end your participation, or end the Beta Program for everyone, at any time, with or without notice. Where reasonable, we will give notice and a chance to export your work.
  • After it ends. When your participation ends, your access to Beta Features ends. Sections 3 (as is), 4, 5, 6, 7, 8, and 11 continue to apply. What happens to your beta data after the Beta Program ends is described in the app's terms and privacy notice, and we will tell participants before any data is deleted.

11. Liability, governing law, and disputes

The disclaimer of warranties, limitation of liability, indemnity, governing law (Colorado), and venue (Arapahoe County, Colorado, or the United States District Court for the District of Colorado) provisions of our Terms of Use apply to the Beta Program and these Beta Terms.
